GAGA OFF THE HOOK: A judge yesterday threw out a lawsuit filed three years ago by one Rebecca Francescatti claiming that Lady Gaga had plagiarized Francescatti’s 1999 composition “Juda” in writing her own “Judas.” In his ruling, U.S. District Judge Marvin E. Aspen wrote that the songs’ similar titles and certain common notes “are not sufficient to give rise to a finding that the Gaga Song has captured the total concept and feel of the Francescatti Song… No reasonable trier of fact could find that the songs’ expressions are substantially similar.” Gaga was repped in the suit by prominent entertainment lawyer and litigation expert Chuck Ortner, who was overheard humming “Poker Face” as he walked out of the courthouse.
